Section 161 of CrPC 1973 :- 161. Examination of witnesses by police — (1) Any police officer making an investigation under this Chapter, or any police officer not below such rank as the State Government may, by general or special order, prescribe in this behalf, acting on the requisition of such officer, may examine orally any person supposed to be acquainted with the facts and circumstances of the case.

(2) Such person shall be bound to answer truly all questions relating to such case put to him by such officer, other than questions the answers to which would have a tendency to expose him to a criminal charge or to a penalty or forfeiture.

(3) The police officer may reduce into writing any statement made to him in the course of an examination under this section; and if he does so, he shall make a separate and true record of the statement of each such person whose statement he records.


[Provided that statement made under this sub-section may also be recorded by audio-video electronic means.].

[Provided further that the statement of a woman against whom an offence under section 354, section 354A, section 354B, section 354C, section 354D, section 376, [section 376A, section 376AB, section 376B, section 376C, section 376D, section 376DA, section 376DB], section 376E or section 509 of the Indian Penal Code (45 of 1860) is alleged to have been committed or attempted shall be recorded, by a woman police officer or any woman officer.]


STATE AMENDMENT

Chhattisgarh - The second proviso to sub-section (3) of section 161 shall be substituted with the following proviso, namely :

"Provided further that statement of the woman against whom an offence under section 354, section 354A, section 354B, section 354C, section 354D, section 354E, section 376, section 376A, section 376B, section 376C, section 376D, section 376E, section 509, section 509A or section 509B of the Indian Penal Code, is alleged to have been committed or attempted, shall be recorded, as far as possible, by woman police officer and shall also be recorded by audio-video means, as far as possible, and it shall be the duty of such police officer to take all such steps as are necessary to protect the identity of the woman.”

दंड प्रक्रिया संहिता 1973 की धारा 161 का विवरण :  -  161. पुलिस द्वारा साक्षियों की परीक्षा -- (1) कोई पुलिस अधिकारी, जो इस अध्याय के अधीन अन्वेषण कर रहा है या ऐसे अधिकारी की अपेक्षा पर कार्य करने वाला कोई पुलिस अधिकारी, जो ऐसी पंक्ति से निम्नतर पंक्ति का नहीं है जिसे राज्य सरकार साधारण या विशेष आदेश द्वारा इस निमित्त विहित करे, मामले के तथ्यों और परिस्थितियों से परिचित समझे जाने वाले किसी व्यक्ति की मौखिक परीक्षा कर सकता है।

(2) ऐसा व्यक्ति उन प्रश्नों के सिवाय, जिनके उत्तरों की प्रवृत्ति उसे आपराधिक आरोप या शास्ति या समपहरण की आशंका में डालने की है, ऐसे मामले से संबंधित उन सब प्रश्नों का सही-सही उत्तर देने के लिए आबद्ध होगा जो ऐसा अधिकारी उससे पूछता है।

(3) पुलिस अधिकारी इस धारा के अधीन परीक्षा के दौरान उसके समक्ष किए गए किसी भी कथन को लेखबद्ध कर सकता है और यदि वह ऐसा करता है, तो वह प्रत्येक ऐसे व्यक्ति के कथन का पृथक् और सही अभिलेख बनाएगा जिसका कथन वह अभिलिखित करता है।


[परन्तु यह कि इस उपधारा के अधीन दिये गए कथन को श्रव्य-दृश्य इलेक्ट्रानिक माध्यम द्वारा भी अभिलिखित किया जा सकेगा।]


[परन्तु यह और कि किसी ऐसी स्त्री का कथन, जिसके विरुद्ध भारतीय दण्ड संहिता (1860 का 45) की धारा 354, धारा 354क, धारा 354ख, धारा 354ग, धारा 354घ, धारा 376, [धारा 376क, धारा 376कख, धारा 376ख, धारा 376ग, धारा 376घ, धारा 376घक, धारा 376घख], धारा 376ङ या धारा 509 के अधीन किसी अपराध के किए जाने या किए जाने का प्रयत्न किए जाने का अभिकथन किया गया है, किसी महिला पुलिस अधिकारी या किसी महिला अधिकारी द्वारा अभिलिखित किया जाएगा।]


राज्य संशोधन



छत्तीसगढ़ -- धारा 161 की उपधारा (3) के द्वितीय परंतुक के स्थान पर, निम्नलिखित प्रतिस्थापित किया जाए, अर्थात् : 

परंतु यह और कि स्त्री का कथन, जिसके विरुद्ध भारतीय दण्ड संहिता की धारा 354, धारा 354क, धारा 354ख, धारा 354ग, धारा 354घ, धारा 354ङ, धारा 376, धारा 376क, धारा 376ख, धारा 376ग, धारा 376घ, धारा 376ङ, धारा 509, धारा 509क या धारा 509ख के अधीन अपराध कारित किये जाने या अपराध करने का प्रयास किये जाने का आरोप है, यथा संभव महिला पुलिस अधिकारी द्वारा अभिलिखित किया जाएगा तथा यथासंभव, ऑडियो-विडियो साधनों द्वारा भी रिकार्ड किया जाएगा और ऐसे पुलिस अधिकारी का यह कर्तव्य होगा कि वह ऐसे सभी कदम उठाये जो स्त्री की पहचान की सुरक्षा हेतु आवश्यक हो।
