Section 157 Motor Vehicles Act, 1988 in Hindi and English



Section 157 of MV Act 1988 :-Transfer of certificate of insurance -- (1) Where a person, in whose favour the certificate of insurance has been issued in accordance with the provisions of this Chapter, transfers to another person the ownership of the motor vehicle in respect of which such insurance was taken together with the policy of insurance relating thereto, the certificate of insurance and the policy described in the certificate shall be deemed to have been transferred in favour of the person to whom the motor vehicle is transferred with effect from the date of its transfer.

Explanation.-- For the removal of doubts, it is hereby clarified that such deemed transfer shall include transfer of rights and liabilities of the said certificate of insurance and policy of insurance.

(2) The transferee shall apply within fourteen days from the date of transfer in the prescribed form to the insurer for making necessary changes in regard to the fact of transfer in the certificate of insurance and the policy described in the certificate in his favour, and the insurer shall make the necessary changes in the certificate and the policy of insurance in regard to the transfer of insurance.

मोटर यान अधिनियम, 1988 की धारा 157 का विवरण :  -  बीमा के प्रमाणपत्र का अंतरण -- (1) जहां व्यक्ति जिसके पक्ष में इस अध्याय के उपबंधों के अनुसार बीमा प्रमाणपत्र जारी किया गया है, ऐसे मोटर यान का स्वामित्व, जिसकी बाबत ऐसा बीमा उससे संबंधित बीमा पालिसी के साथ अन्य व्यक्ति को अंतरित करता है, बीमा प्रमाणपत्र और प्रमाणपत्र में वर्णित पालिसी ऐसे व्यक्ति, जिसको मोटरयान अंतरित किया जाता है के पक्ष में उसके स्थानांतरण की तारीख से अंतरित की गई समझी जाएगी ।   

स्पष्टीकरण.-- शंकाओं को दूर करने के लिए यह घोषित किया जाता है कि ऐसा समझा गया अंतरण उक्त बीमा प्रमाणपत्र और बीमा पालिसी के अधिकारों और दायित्वों को सम्मिलित करेगा ।

(2) अंतरिती, अंतरण की तारीख से चौदह दिनों के भीतर विहित प्ररूप में बीमाकर्ता को बीमा प्रमाणपत्र और उसके पक्ष में प्रमाणपत्र में वर्णित पालिसी में अंतरण के तथ्यों के संबंध में आवश्यक परिवर्तन करने के लिए आवेदन कर सकेगा और बीमाकर्ता प्रमाणपत्र और बीमा के अंतरण के संबंध में बीमा की पालिसी में आवश्यक परिवर्तन करेगा।
