Section 149 of MV Act 1988 :- Settlement by insurance company and procedure therefor --  (1) The insurance company shall, upon receiving information of the accident, either from claimant or through accident information report or otherwise, designate an officer to settle the claims relating to such accident.

(2) An officer designated by the insurance company for processing the settlement of claim of compensation may make an offer to the claimant for settlement before the Claims Tribunal giving such details, within thirty days and after following such procedure as may be prescribed by the Central Government.

(3) If, the claimant to whom the offer is made under sub-section (2),--

(a) accepts such offer,--

(i) the Claims Tribunal shall make a record of such settlement, and such claim shall be deemed to be settled by consent; and

(ii) the payment shall be made by the insurance company within a maximum period of thirty days from the date of receipt of such record of settlement;

(b) rejects such offer, a date of hearing shall be fixed by the Claims Tribunal to adjudicate such claim on merits.

मोटर यान अधिनियम, 1988 की धारा 149 का विवरण :  -  बीमा कंपनी द्वारा निपटारा और इसके लिए प्रक्रिया -- (1) बीमा कंपनी, या तो दावाकर्ता या दुर्घटना सूचना संबंधी रिपोर्ट के माध्यम से या अन्यथा दुर्घटना की सूचना प्राप्त होने पर ऐसी दुर्घटना के संबंध में दावों के निपटारे के लिए एक अधिकारी पदाभिहित करेगी ।

(2) प्रतिकर के दावों के निपटारे की प्रक्रिया के लिए बीमा कंपनी द्वारा पदाभिहित अधिकारी तीस दिन के भीतर, ऐसे ब्यौरे देते हुए और ऐसी प्रक्रियाओं, जैसा विहित किया जाए, का अनुसरण करने के पश्चात् दावा अधिकरण के समक्ष निपटारा करने के लिए दावाकर्ता को एक प्रस्ताव कर सकेगा ।

(3) यदि दावाकर्ता जिसको उपधारा (2) के अधीन प्रस्ताव किया गया है, --

(क) ऐसा प्रस्ताव स्वीकार करता है, तो,-- 

(i) दावा अधिकरण ऐसे निपटारे का एक अभिलेख तैयार करेगा, और ऐसा दावा सहमति द्वारा निपटाया गया समझा जाएगा, और

(ii) बीमा कंपनी द्वारा समझौते का ऐसा अभिलेख प्राप्त होने की तारीख से अधिकतम तीस दिनों की अवधि के भीतर संदाय किया जाएगा ।

(ख) ऐसा प्रस्ताव नामंजूर करता है, तो ऐसे दावे का गुणावगुण पर न्यायनिर्णयन करने के लिए दावा अधिकरण द्वारा सुनवाई की तारीख नियत की जाएगी ।
