Section 129 Motor Vehicles Act, 1988 in Hindi and English

Section 129 of MV Act 1988 :- Wearing of protective headgear -- Every person, above four years of age, driving or riding or being carried on a motorcycle of any class or description shall, while in a public place, wear protective headgear conforming to such standards as may be prescribed by the Central Government:

Provided that the provisions of this section shall not apply to a person who is a Sikh, if, while driving or riding on the motorcycle, in a public place, he is wearing a turban :

Provided further that the Central Government may by rules provide for measures for the safety of children below four years of age riding or being carried on a motorcycle.

Explanation -- “Protective headgear” means a helmet which, --

(a) by virtue of its shape, material and construction, could reasonably be expected to afford to the person driving or riding on a motorcycle a degree of protection from injury in the event of an accident; and

(b) is securely fastened to the head of the wearer by means of straps or other fastenings provided on the headgear.

मोटर यान अधिनियम, 1988 की धारा 129 का विवरण :  -   सुरक्षात्मक सिर के पहनावे का पहना जाना -- ऐसा प्रत्येक व्यक्ति, जिसकी आयु चार वर्ष से अधिक है और जो किसी वर्ग या विवरण की मोटर साइकिल का चालन या उसकी सवारी कर रहा है या उस पर ले जाया जा रहा है और जब वह सार्वजनिक स्थान पर हो, ऐसे मानकों के अनुरूप सुरक्षात्मक सिर के पहनावे को पहनेगा, जैसा केन्द्रीय सरकार द्वारा विहित किया जाए :

परंतु इस धारा के उपबंध ऐसे किसी व्यक्ति को लागू नहीं होंगे, जो कि सिख है और जब वह सार्वजनिक स्थान पर मोटर साइकिल का चालन या उस पर सवारी कर रहा हो, तो पगड़ी धारण कर रहा है :

परंतु यह और कि केन्द्रीय सरकार नियमों द्वारा मोटर साइकिल का चालन या उस पर सवारी करने वाले चार वर्ष से कम आयु की बालकों की सुरक्षा के लिए उपायों का उपबंध कर सकेगी ।

स्पष्टीकरण -- “सुरक्षात्मक सिर के पहनावे" से ऐसा कोई हेलमेट अभिप्रेत है,--

(क) जिससे उसके आकार, सामग्री और संरचना के कारण युक्तियुक्त रूप से यह आशा की जा सकती है कि वह किसी दुर्घटना की दशा में किसी मोटर साइकिल का चालन या उस पर सवारी करने वाले व्यक्ति को शारीरिक क्षति से किसी हद तक सुरक्षा प्रदान करेगा; और

(ख) जिसे उसको पहनने वाले व्यक्ति के सिर पर सुरक्षित रूप से, सिर के पहनावे में लगे हुए स्ट्रैप या अन्य बंधकों के द्वारा कस कर बांधा जाता है ।
