Section 113 of CrPC 1973 :- 113. Summons or warrant in case of person not so present --- If such person is not present in Court, the Magistrate shall issue a summons requiring him to appear, or, when such person is in custody, a warrant directing the officer in whose custody he is to bring him before the Court :


          Provided that whenever it appears to such Magistrate, upon the report of a police officer or upon other information (the substance of which report or information shall be recorded by the Magistrate), that there is reason to fear the commission of a breach of the peace and that such breach of the peace cannot be prevented otherwise than by immediate arrest of such person, the Magistrate may at any time issue a warrant for his arrest.

दंड प्रक्रिया संहिता 1973 की धारा 113 का विवरण :  -  113. ऐसे व्यक्ति के बारे में समन या वारण्ट जो उपस्थित नहीं है -- यदि ऐसा व्यक्ति न्यायालय में उपस्थित नहीं है तो मजिस्ट्रेट उससे हाजिर होने की अपेक्षा करते हुए समन, या जब ऐसा व्यक्ति अभिरक्षा में है तब जिस अधिकारी की अभिरक्षा में वह है उस अधिकारी को उसे न्यायालय के समक्ष लाने का निदेश देते हुए वारण्ट, जारी करेगा :

             परन्तु जब कभी ऐसे मजिस्ट्रेट को पुलिस अधिकारी की रिपोर्ट पर या अन्य इत्तिला पर (जिस रिपोर्ट या इत्तिला का सार मजिस्ट्रेट द्वारा अभिलिखित किया जाएगा), यह प्रतीत होता है कि परिशांति भंग होने के डर के लिए कारण है और ऐसे व्यक्ति की तुरन्त गिरफ्तारी के बिना ऐसे परिशांति भंग करने का निवारण नहीं किया जा सकता है तब वह मजिस्ट्रेट उसकी गिरफ्तारी के लिए किसी समय वारण्ट जारी कर सकेगा।
