Section 110B Motor Vehicles Act, 1988 in Hindi and English

Section 110B of MV Act 1988 :- Type-approval certificate and testing agencies -- (1) No motor vehicle, including a trailer or semi-trailer or modular hydraulic trailer or side car shall be sold or delivered or offered for sale or delivery or used in a public place in India unless a type-approval certificate referred to in sub-section (2) has been issued in respect of such vehicle :

Provided that the Central Government may, by notification in the Official Gazette, extend the requirement of type-approval certificate to other vehicles drawn or intended to be drawn by a motor vehicle :

Provided further that such certificate shall not be required for vehicles which are--

(a) intended for export or display or demonstration or exhibition; or

(b) used by a manufacturer of motor vehicles or motor vehicle components or a research and development centre or a test by agency for testing and validation or for data collection, inside factory premises or in a non public place; or

(c) exempted by the Central Government.

(2) The manufacturer or importer of motor vehicles including trailers, semi-trailers, modular hydraulic trailers and side cars shall submit the prototype of the vehicle to be manufactured or imported for test to a testing agency for obtaining a type-approval certificate by such agency.

(3) The Central Government shall make rules for the accreditation, registration and regulation of testing agencies.

(4) The testing agencies shall conduct tests on vehicles drawn from the production line of the manufacturer or obtained otherwise to verify the conformity of such vehicles to the provisions of this Chapter and the rules and regulations made thereunder.

(5) Where the motor vehicle having a type-approval certificate is recalled under section 110A, the testing agency which granted the certificate to such motor vehicle shall be liable for its accreditation and registration to be cancelled.

मोटर यान अधिनियम, 1988 की धारा 110B का विवरण :  -  किस्म-अनुमोदन प्रमाणपत्र और परीक्षण अभिकरण -- (1) किसी भी मोटर यान का, जिसके अंतर्गत कोई ट्रेलर या अर्ध ट्रेलर या माड्युलर या हाइड्रोलिक ट्रेलर या साइड कार भी है, तब तक भारत में विक्रय या परिदान या किसी सार्वजनिक स्थान में उपयोग नहीं किया जाएगा, जब तक कि उपधारा (2) में ऐसे यान के संबंध में निर्दिष्ट किस्म-अनुमोदन प्रमाणपत्र जारी न कर दिया गया हो :

परंतु केन्द्रीय सरकार, राजपत्र में अधिसूचना द्वारा, किसी मोटर यान द्वारा खींचे जाने वाले या खींचे जाने के लिए आशयित अन्य यानों के किस्म-अनुमोदन प्रमाणपत्र की अपेक्षा को विस्तारित कर सकेगी :

परंतु यह और कि ऐसा प्रमाणपत्र ऐसे यानों के लिए अपेक्षित नहीं होगा,--

(क) जो निर्यात के लिए अथवा प्रदर्शन या निदर्शन या संप्रदर्शन के लिए आशयित हैं; या

(ख) जिनका उपयोग मोटर यानों या मोटर यान संघटकों के किसी विनिर्माता या किसी अनुसंधान और विकास केंद्र द्वारा किया जाता है या जिनकी परीक्षा किसी परीक्षण और विधिमान्यकरण अभिकरण द्वारा या किसी डाटा संग्रहण के लिए किन्हीं कारखाना परिसरों के भीतर किसी गैर-सार्वजनिक स्थान पर किया जाता है; या

(ग) जिन्हें केन्द्रीय सरकार द्वारा छूट प्राप्त है 

(2) ऐसे मोटर यानों का, जिसके अंतर्गत कोई ट्रेलर या अर्ध टेलर या माड्यूलर या हाइड्रोलिक ट्रेलर या साइड कार भी है, विनिर्माता या आयातकर्ता किस्म-अनुमोदन प्रमाणपत्र अभिप्राप्त करने के लिए किसी परीक्षण अभिकरण को विनिर्मित या आयातित किए जाने वाले यान की प्रोटोकिस्म परीक्षण के लिए प्रस्तुत करेगा।

(3) केन्द्रीय सरकार, परीक्षण अभिकरणों के प्रत्यायन, रजिस्ट्रीकरण और विनियमन के लिए नियम बनाएगी ।

(4) परीक्षण अभिकरण, विनिर्माता की उत्पादन पंक्ति से लिए गए यानों या अन्यथा अभिप्राप्त किए गए यानों का यह सत्यापन करने के लिए परीक्षण करेंगे कि ऐसे यान इस अध्याय और तद्धीन बनाए गए नियमों और विनियमों के उपबंधों के अनुरूप हैं ।

(5) जहां किस्म-अनुमोदन प्रमाणपत्र धारण करने वाले किसी मोटर यान को धारा 110क के अधीन वापस बुलाया जाता है, वहां ऐसा परीक्षण अभिकरण, जिसने ऐसे मोटर यान को प्रमाणपत्र मंजूर किया था, उसके प्रत्यायन और रजिस्ट्रीकरण को रद्द किए जाने के लिए दायी होगा ।
