Section 105I of CrPC 1973 :- 105 i.- Fine in lieu of forfeiture — (1) Where the Court makes a declaration that any property stands forfeited to the Central Government under section 105H and it is a case where the source of only a part of such property has not been proved to the satisfaction of the Court, it shall make an order giving an option to the person affected to pay, in lieu of forfeiture, a fine equal to the market value of such part.

(2) Before making an order imposing a fine under sub-section (1), the person affected shall be given a reasonable opportunity of being heard.

(3) Where the person affected pays the fine due under sub-section (1), within such time as may be allowed in that behalf, the Court may, by order, revoke the declaration of forfeiture under section 105H and thereupon such property shall stand released.

दंड प्रक्रिया संहिता 1973 की धारा 105 झ का विवरण :  -  105 झ.- समपहरण के बदले जुर्माना -- (1) जहाँ न्यायालय यह घोषणा करता है कि कोई संपत्ति धारा 105 ज के अधीन केन्द्रीय सरकार को समपहृत हो गई है और यह ऐसा मामला है जहाँ ऐसी संपत्ति के केवल कुछ भाग का स्रोत न्यायालय को समाधानप्रद रूप में साबित नहीं किया गया है वहाँ वह प्रभावित व्यक्ति को, समपहरण के बदले में ऐसे भाग के बाजार मूल्य के बराबर जुर्माने का संदाय करने का विकल्प देते हुए, आदेश देगा।

(2) उपधारा (1) के अधीन जुर्माना अधिरोपित करने का आदेश देने के पूर्व, प्रभावित व्यक्ति को सुनवाई का युक्तियुक्त अवसर दिया जाएगा।

(3) जहाँ प्रभावित व्यक्ति, उपधारा (1) के अधीन देय जुर्माने का ऐसे समय के भीतर, जो उस निमित्त अनुज्ञात किया जाए, संदाय कर देता है वहाँ न्यायालय, आदेश द्वारा, धारा 105 ज के अधीन की गई समपहरण की घोषणा का प्रतिसंहरण कर सकेगा और तब ऐसी संपत्ति निर्मुक्त हो जाएगी।
