Section 100 of MV Act 1988 :-  Objection to the proposal -- (1) On the publication of any proposal regarding a scheme in the Official Gazette and in not less than one newspaper in the regional language circulating in the area or route which is to be covered by such proposal any person may, within thirty days from the date of its publication in the Official Gazette, file objections to it before the State Government.

(2) The State Government may, after considering the objections and after giving an opportunity to the objector or his representatives and the representatives of the State transport undertaking to be heard in the matter, if they so desire, approve or modify such proposal.

(3) The scheme relating to the proposal as approved or modified under subsection (2) shall then be published in the Official Gazette by the State Government making such scheme and in not less than one newspaper in the regional language circulating in the area or route covered by such scheme and the same shall thereupon become final on the date of its publication in the Official Gazette and shall be called the approved scheme and the area or route to which it relates shall be called the notified area or notified route :

Provided that no such scheme which relates to any inter-State route shall be deemed to be an approved scheme unless it has the previous approval of the Central Government

(4) Notwithstanding anything contained in this section, where a scheme is not published as an approved scheme under sub-section (3) in the Official Gazette within a period of one year from the date of publication of the proposal regarding the scheme in the Official Gazette under sub-section (1), the proposal shall be deemed to have lapsed.

Explanation -- In computing the period of one year referred to in this subsection, any period or periods during which the publication of the approved scheme under sub-section (3) was held up on account of any stay or injunction by the order of any court shall be excluded.

मोटर यान अधिनियम, 1988 की धारा 100 का विवरण :  -   प्रस्थापना पर आपत्ति -- (1) राजपत्र में किसी स्कीम के संबंध में प्रस्थापना के प्रकाशन पर तथा उस क्षेत्र या मार्ग में, जिसमें ऐसी स्कीम चलाने की प्रस्थापना है, परिचालित प्रादेशिक भाषा से कम से कम एक समाचार-पत्र में प्रकाशन पर कोई भी व्यक्ति राजपत्र में उसके प्रकाशन की तारीख से तीस दिन के अन्दर उसके बारे में आपत्तियां राज्य सरकार के समक्ष फाइल कर सकेगा ।

(2) राज्य सरकार ऐसी आपत्तियों पर विचार करने के पश्चात् तथा आपत्तिकर्ता या उसके प्रतिनिधियों, और राज्य परिवहन उपक्रम के प्रतिनिधियों को, यदि वे ऐसा चाहें, इस विषय में सुनव का अवसर देने के पश्चात्, ऐसी प्रस्थापना का अनुमोदन या उसमें परिवर्तन कर सकेगी।

(3) उपधारा (2) के अधीन अनुमोदित या उपांतरित रूप में प्रस्थापना से संबंधित स्कीम तब ऐसी स्कीम बनाने वाली राज्य सरकार द्वारा राजपत्र में और उस स्कीम के अन्तर्गत आने वाले क्षेत्र या मार्ग में परिचालित प्रादेशिक भाषा के कम से कम एक समाचार-पत्र में प्रकाशित की जाएगी और वैसा हो जाने पर वह राजपत्र में प्रकाशन की तारीख को अन्तिम होगा तथा अनुमोदित स्कीम कही जाएगी और जिस क्षेत्र या मार्ग से वह संबंधित है वह अधिसूचित क्षेत्र या अधिसूचित मार्ग कहलाएगा :

परन्तु ऐसी कोई स्कीम, जो किसी अंतरराज्यिक मार्ग से संबंधित है, तभी अनुमोदित स्कीम समझी जाएगी जब उस पर केन्द्रीय सरकार का पूर्व अनुमोदन हो, अन्यथा नहीं ।

(4) इस धारा में किसी बात के होते हए भी. जहां कोई स्कीम उपधारा (1) के अधीन स्कीम से संबंधित प्रस्थापना के राजपत्र में प्रकाशन की तारीख से एक वर्ष की अवधि के अन्दर राजपत्र में उपधारा (3) के अधीन अनुमोदित स्कीम के रूप में प्रकाशित नहीं की जाती है जहां वह प्रस्थापना व्यपगत हो गई समझी जाएगी ।

स्पष्टीकरण -- इस उपधारा में निर्दिष्ट एक वर्ष की अवधि की संगणना करने में ऐसी कालावधि या कालावधियां जिनके दौरानं उपधारा (3) के अधीन अनुमोदित स्कीम का प्रकाशन किसी न्यायालय के रोक आदेश या आदेश के कारण रुक गया था, अपवर्जित कर दी जाएंगी।
