Section 10 Evidence Act 1872 : Things said or done by conspirator in reference to common design --- Where there is reasonable ground to believe that two or more persons have conspired together to commit an offence or an actionable wrong, anything said, done or written by any one of such persons in reference to their common intention, after the time when such intention was first entertained by any one of them, is a relevant fact as against each of the persons believed to be so conspiring, as well for the purpose of proving the existence of the conspiracy as for the purpose of showing that any such person was a party to it.

Illustration

Reasonable ground exists for believing that A has joined in a conspiracy to wage war against the Government of India.

The facts that B procured arms in Europe for the purpose of the conspiracy, C collected money in Calcutta for a like object, D persuaded persons to join the conspiracy in Bombay, E published writings advocating the object in view at Agra, and F transmitted from Delhi to G at Kabul the money which C had collected at Calcutta, and the contents of a letter written by H giving an account of the conspiracy, are each relevant, both to prove the existence of the conspiracy, and to prove A's complicity in it, although he may have been ignorant of all of them, and although the persons by whom they were done, were strangers to him, and although they may have taken place before he joined the conspiracy or after he left it.

भारतीय साक्ष्य अधिनियम, 1872 की धारा 10 का विवरण :  -  सामान्य परिकल्पना के बारे में षड़यंत्रकारी द्वारा कही या की गई बातें -- जहां कि यह विश्वास करने का युक्तियुक्त आधार है कि दो या अधिक व्यक्तियों ने अपराध या अनुयोज्य दोष करने के लिए मिलकर षड़यंत्र किया है, वहां उनके सामान्य आशय के बारे में उनमें से किसी एक व्यक्ति द्वारा उस समय के पश्चात् जब ऐसा आशय उनमें से किसी एक ने प्रथम बार मन में धारण किया, कही गई या लिखी गई कोई बात उन व्यक्तियों में से हर एक व्यक्ति के विरुद्ध, जिनके बारे में विश्वास किया जाता है, कि उन्होंने इस प्रकार षड़यंत्र किया है, षड़यंत्र का अस्तित्व साबित करने के प्रयोजनार्थ उसी प्रकार सुसंगत तथ्य है, जिस प्रकार यह दर्शित करने के प्रयोजनार्थ कि ऐसा कोई व्यक्ति उसका पक्षकार था।

दृष्टांत

यह विश्वास करने का युक्तियुक्त आधार है कि क भारत सरकार के विरुद्ध युद्ध करने के षड़यंत्र में सम्मिलित हुआ है।

ख ने उस षड़यंत्र के प्रयोजनार्थ यूरोप में आयुध उपाप्त किए, ग ने वैसे ही उद्देश्य से कलकत्ते में धन संग्रह किया, घ ने मुम्बई में लोगों को उस षड़यंत्र में सम्मिलित होने के लिए प्रेरित किया, ङ ने आगरे में उस उद्देश्य के पक्षपोषण में लेख प्रकाशित किए और ग द्वारा कलकत्ते में संगृहीत धन कोच ने दिल्ली से छ के पास काबुल भेजा। इन तथ्यों और उस षड़यंत्र का वृत्तांत देने वाले झ द्वारा लिखित पत्र की अन्तर्वस्तु में से हर एक षड़यंत्र का अस्तित्व साबित करने के लिए तथा उसमें क की सह-अपराधिता साबित करने के लिए भी सुसंगत है, चाहे वह उन सभी के बारे में अनभिज्ञ रहा हो और चाहे उन्हें करने वाले व्यक्ति उसके लिए अपरिचित रहे हों और चाहे वे उसके षड़यंत्र में सम्मिलित होने से पूर्व या उसके षड़यंत्र से अलग हो जाने के पश्चात् घटित हुए हों।
