Section 1 Indian Evidence Act 1872 in Hindi and English 



Section 1 Evidence Act 1872 :Short title, extent and commencement --- This Act may be called the Indian Evidence Act, 1872.

It extends to the whole of India [The words "except the State of Jammu and Kashmir" omitted by Act 34 of 2019, s. 95 and the Fifth Schedule (w.e.f. 31-10- 2019)] and applies to all judicial proceedings in or before any Court, including Courts-martial, other than Courts-martial convened under the Army Act, (44 & 45 Vict, C. 58), the Naval Discipline Act (29 & 30 Vict., C. 109) or the Indian Navy (Discipline) Act, 1934 (34 of 1934) or the Air Force Act (7 Geo.5, C. 51) but not to affidavits presented to any Court or Officer, nor to proceedings before an arbitrator; and it shall come into force on the first day of September, 1872.

भारतीय साक्ष्य अधिनियम, 1872 की धारा 1 का विवरण :  -  संक्षिप्त नाम, विस्तार और प्रारंभ -- यह अधिनियम भारतीय साक्ष्य अधिनियम, 1872 कहा जा सकेगा।

इसका विस्तार संपूर्ण भारत पर है [The words "except the State of Jammu and Kashmir" omitted by Act 34 of 2019, s. 95 and the Fifth Schedule (w.e.f. 31-10- 2019)] और यह किसी न्यायालय में या के समक्ष की जिसके अन्तर्गत आर्मी ऐक्ट, (44 तथा 45 विक्टो, अ. 58), नेवल डिसिप्लिन ऐक्ट (29 तथा 30 तथा विक्टो, म. 109) या इंडियन नेवी (डिसिप्लिन) ऐक्ट, 1934 (1934 का 34) या एयर फोर्स ऐक्ट (7 जा. 5, अ. 51) के अधीन संयोजित सेना न्यायालयों से भिन्न सेना न्यायालय आते हैं, समस्त न्यायिक कार्यवाहियों को लागू हैं, किन्तु न तो किसी न्यायालय या ऑफिसर के समक्ष पेश किए शपथ पत्रों को और न किसी मध्यस्थ के समक्ष की कार्यवाहियों को लागू है; और यह 1872 के सितम्बर के प्रथम दिन को प्रवृत्त होगा।
