 Section 41A The Factories Act, 1948 : 

Constitution of Site Appraisal Committees.—

(1) The State Government may, for purposes of advising it to consider applications for grant of permission for the initial location of a factory involving a hazardous process or for the expansion of any such factory, appoint a Site Appraisal Committee consisting of—

(a) the Chief Inspector of the State who shall be its Chairman;

(b) a representative of the Central Board for the Prevention and Control of Water Pollution appointed by the Central Government under section 3 of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974);

(c) a representative of the Central Board for the Prevention and Control of Air Pollution referred to in section 3 of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981);

(d) a representative of the State Board appointed under section 4 of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974);

(e) a representative of the State Board for the Prevention and Control of Air Pollution referred to in section 5 of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981);

(f) a representative of the Department of Environment in the State;

(g) a representative of the Meteorological Department of the Government of India;

(h) an expert in the field of occupational health; and

(i) a representative of the Town Planning Department of the State Government, and not more than five other members who may be co-opted by the State Government who shall be—

(i) a scientist having specialised knowledge of the hazardous process which will be involved in the factory,

(ii) a representative of the local authority within whose jurisdiction the factory is to be established, and

(iii) not more than three other persons as deemed fit by the State Government.

(2) The Site Appraisal Committee shall examine an application for the establishment of a factory involving hazardous process and make its recommendation to the State Government within a period of ninety days of the receipt of such application in the prescribed form.

(3) Where any process relates to a factory owned or controlled by the Central Government or to a corporation or a company owned or controlled by the Central Government, the State Government shall co-opt in the Site Appraisal Committee a representative nominated by the Central Government as a member of that Committee.

(4) The Site Appraisal Committee shall have power to call for any information from the person making an application for the establishment or expansion of a factory involving a hazardous process.

(5) Where the State Government has granted approval to an application for the establishment or expansion of a factory involving a hazardous process, it shall not be necessary for an applicant to obtain a further approval from the Central Board or the State Board established under the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981).

कारखाना अधिनियम, 1948 की धारा 41क का विवरण - 

 स्थल मूल्यांकन समितियों का गठन-(1) राज्य सरकार, किसी ऐसे कारखाने के, जिसमें कोई परिसंकटमय प्रक्रिया अन्तर्वलित है, प्रारंभिक स्थान के लिए अनुज्ञा देने या किसी ऐसे कारखाने के विस्तार के लिए आवेदनों पर विचार करने के लिए उसे सलाह देने के प्रयोजनों के लिए एक स्थल मूल्यांकन समिति नियुक्त कर सकेगी, जिसमें निम्नलिखित होंगे :-

(क) राज्य का मुख्य निरीक्षक जो उसका अध्यक्ष होगा;

(ख) जल (प्रदूषण निवारण तथा नियंत्रण) अधिनियम, 1974 (1974 का 6) की धारा 3 के अधीन केन्द्रीय सरकार द्वारा नियुक्त जल प्रदूषण के निवारण तथा नियंत्रण के लिए केन्द्रीय बोर्ड का एक प्रतिनिधि;  

(ग) वायु (प्रदूषण निवारण और नियंत्रण) अधिनियम, 1981 (1981 का 14) की धारा 3 में निर्दिष्ट वायु प्रदूषण के निवारण और नियंत्रण के लिए केन्द्रीय बोर्ड का एक प्रतिनिधि;

(घ) जल (प्रदूषण निवारण तथा नियंत्रण) अधिनियम, 1974 (1974 का 6) की धारा 4 के अधीन नियुक्त राज्य बोर्ड का एक प्रतिनिधि;

(ङ) वायु (प्रदूषण निवारण और नियंत्रण) अधिनियम, 1981 (1981 का 14) की धारा 5 में निर्दिष्ट वायु प्रदूषण निवारण और नियंत्रण के लिए राज्य बोर्ड का एक प्रतिनिधि; 

(च) राज्य के पर्यावरण विभाग का एक प्रतिनिधि; 

(छ) भारत सरकार के मौसम विज्ञान विभाग का एक प्रतिनिधि; 

(ज) उपजीविका से संबंधित स्थास्थ्य के क्षेत्र का एक विशेषज्ञ; और 

(झ) राज्य सरकार के शहरी योजना विभाग का एक प्रतिनिधि,

और पांच से अनधिक ऐसे अन्य सदस्य होंगे जो राज्य सरकार द्वारा सहयोजित किए जा सकेंगे, अर्थात् :-

(i) एक ऐसा वैज्ञानिक होगा जिसके पास उस परिसंकटमय प्रक्रिया का जो कारखाने में अंतर्वलित होगी, विशेषज्ञीय ज्ञान है, 

(ii) उस स्थानीय प्राधिकारी का एक प्रतिनिधि होगा जिसकी अधिकारिता के भीतर कारखाना स्थापित किया जाना है, और

(iii) तीन से अनधिक ऐसे अन्य व्यक्ति होंगे जिन्हें राज्य सरकार योग्य समझे । 

(2) स्थल मूल्यांकन समिति, किसी ऐसे कारखाने की, जिसमें परिसंकटमय प्रक्रिया अन्तर्वलित है, स्थापना के लिए आवेदन की जांच करेगी और विहित प्ररूप में ऐसे आवेदनों की प्राप्ति से नब्बे दिन की अवधि के भीतर राज्य सरकार को अपनी सिफारिश करेगी ।

(3) जहां कोई प्रक्रिया केन्द्रीय सरकार के स्वामित्व या उसके द्वारा नियंत्रित किसी कारखाने से या केन्द्रीय सरकार के स्वामित्व या उसके द्वारा नियंत्रित किसी निगम या किसी कम्पनी से संबंधित है, वहां राज्य सरकार स्थल मूल्यांकन समिति में केंद्रीय सरकार द्वारा नामनिर्दिष्ट प्रतिनिधि को उस समिति के एक सदस्य के रूप में सहयोजित करेगी ।

(4) स्थल मूल्यांकन समिति की यह शक्ति होगी कि वह किसी ऐसे कारखाने की, जिसमें कोई परिसंकटमय प्रक्रिया अन्तर्वलित है, स्थापना या विस्तार के लिए आवेदन करने वाले व्यक्ति से किसी भी जानकारी की मांग करेगी ।

(5) जहां राज्य सरकार ने ऐसे कारखाने की, जिसमें कोई परिसंकटमय प्रक्रिया अन्तर्वलित है, स्थापना या विस्तार के लिए आवेदन को अनुमोदित कर दिया है, वहां आवेदक के लिए, यह आवश्यक नहीं होगा कि वह जल (प्रदूषण निवारण तथा नियंत्रण) अधिनियम, 1974 (1974 का 6) और वायु (प्रदूषण निवारण और नियंत्रण) अधिनियम, 1981 (1981 का 14) के अधीन स्थापित केन्द्रीय बोर्ड या राज्य बोर्ड से पुनः अनुमोदन प्राप्त करे ।
