Section 136 The Trade Marks Act, 1999: 

Registered user to be impleaded in certain proceedings.—

(1) In every proceeding under Chapter VII or under section 91, every registered user of a trade mark using by way of permitted use, who is not himself an applicant in respect of any proceeding under that Chapter or section, shall be made a party to the proceeding.

(2) Notwithstanding anything contained in any other law, a registered user so made a party to the proceeding shall not be liable for any costs unless he enters an appearance and takes part in the proceeding.

व्यापार चिह्न अधिनियम, 1999 की धारा 136 का विवरण : 

रजिस्ट्रीकृत उपयोक्ता को कतिपय कार्यवाहियों में पक्षकार बनाया जाना-(1) अध्याय 7 के अधीन या धारा 91 के अधीन प्रत्येक कार्यवाही में अनुज्ञात उपयोग के रूप में व्यापार चिह्न का उपयोग करने वाले रजिस्ट्रीकृत उपयोक्ता को, जो उस अध्याय या धारा के अधीन किसी कार्यवाही की बाबत स्वयं आवेदक नहीं है, कार्यवाही में पक्षकार बनाया जाएगा ।

(2) किसी अन्य विधि में किसी बात के होते हुए भी, कार्यवाही का इस प्रकार पक्षकार बनाया गया रजिस्ट्रीकृत उपयोक्ता किसी खर्चे के लिए तब तक दायी नहीं होगा जब तक कि वह उपसंजात न हो और कार्यवाहियों में भाग न ले ।
