 State of Gujarat vs Turabali Gulamhussain Hirani - Important Supreme Court Case 2007


On 4th October, 2007, a two Judges Bench in State of Gujarat vs Turabali Gulamhussain Hirani & Anr [Criminal Appeal No.1338 of 2007] deprecated "frequent, casual and lackadaisical summoning of high officials by the Court." The Bench observed that "summoning a senior official, except in some very rare and exceptional situation, and that too for compelling reasons, is counter productive and may also involve heavy expenses and valuable time of the official concerned."


"The judiciary must have respect for the executive and the legislature", the Bench said.
