Section 494 of IPC 1860:- Marrying again during lifetime of husband or wife -

Whoever, having a husband or wife living, marries in any case in which such marriage is void by reason of its taking place during the life of such husband or wife, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.

Exception - This section does not extend to any person whose marriage with such husband or wife has been declared void by a Court of competent jurisdiction, 

nor to any person who contracts a marriage during the life of a former husband or wife, if such husband or wife, at the time of the subsequent marriage, shall have been continually absent from such person for the space of seven years, and shall not have been heard of by such person as being alive within that time provided the person contracting such subsequent marriage shall, before such marriage takes place, inform the person with whom such marriage is contracted of the real state of facts so far as the same are within his or her knowledge.

आईपीसी, 1860 (भारतीय दंड संहिता) की धारा 494 का विवरण - पति या पत्नी के जीवनकाल में पुनः विवाह करना -

जो कोई पति या पत्नी के जीवित होते हुए किसी ऐसी दशा में विवाह करेगा जिसमें ऐसा विवाह इस कारण शून्य है कि वह ऐसी पति या पत्नी के जीवनकाल में होता है, वह दोनों में से किसी भांति के कारावास से, जिसकी अवधि सात वर्ष तक की हो सकेगी, दण्डित किया जाएगा और जुर्माने से भी दण्डनीय होगा।

अपवाद - इस धारा का विस्तार किसी ऐसे व्यक्ति पर नहीं है, जिसका ऐसे पति या पत्नी के साथ विवाह सक्षम अधिकारिता के न्यायालय द्वारा शून्य घोषित कर दिया गया हो,

और न किसी ऐसे व्यक्ति पर है, जो पूर्व पति या पत्नी के जीवनकाल में विवाह कर लेता है, यदि ऐसा पति या पत्नी उस पश्चातवर्ती विवाह के समय ऐसे व्यक्ति से सात वर्ष तक निरंतर अनुपस्थित रहा हो, और उस काल के भीतर ऐसे व्यक्ति ने यह नहीं सुना हो कि वह जीवित है, परन्तु यह तब जबकि ऐसा पश्चात्वर्ती विवाह करने वाला व्यक्ति उस विवाह के होने से पूर्व उस व्यक्ति को, जिसके साथ ऐसा विवाह होता है, तथ्यों की वास्तविक स्थिति की जानकारी, जहां तक कि उनका ज्ञान उसको हो, दे दे।
