Section 441 of IPC 1860:- Criminal trespass -

Whoever enters into or upon property in the possession of another with intent to commit an offence or to intimidate, insult or annoy any person in possession of such property, or having lawfully entered into or upon such property, unlawfully remains there with intent thereby to intimidate, insult or annoy any such person, or with intent to commit an offence, is said to commit "criminal trespass”.

STATE AMENDMENT

Uttar Pradesh - For section 441, substitute the following

441. Criminal Trespass - Whoever enters into or upon property in possession of another with intent to commit an offence or to intimidate, insult or annoy any person in possession of such property, or having lawfully entered into or upon such property, unlawfully remains there with intent thereby to intimidate, insult or annoy any such person, or with intent to commit an offence, or, having entered into or upon such property, whether before or after the coming into force of the Criminal Law (U.P. Amendment) Act, 1961, with the intention of taking unauthorised possession or making unauthorised use of such property fails to withdraw from such property or its possession or use, when called upon to do so by that another person by notice in writing, duly served upon him, by the date specified in the notice, is said to commit “criminal trespass”.

आईपीसी, 1860 (भारतीय दंड संहिता) की धारा 441 का विवरण - आपराधिक अतिचार -

जो कोई किसी ऐसी संपत्ति में या ऐसी संपत्ति पर, जो किसी दूसरे के कब्जे में है, इस आशय से प्रवेश करता है, कि वह कोई अपराध करे या किसी व्यक्ति को, जिसके कब्जे में ऐसी संपत्ति है, अभित्रस्त, अपमानित या क्षुब्ध करे, अथवा ऐसी संपत्ति में या ऐसी संपत्ति पर, विधिपूर्वक प्रवेश करके वहां विधिविरुद्ध रूप में इस आशय में बना रहता है कि तद्द्वारा वह किसी ऐसे व्यक्ति को अभित्रस्त, अपमानित या क्षुब्ध करे या इस आशय से बना रहता है, वह कोई अपराध करे, वह "आपराधिक अतिचार" करता है, यह कहा जाता है।

राज्य संशोधन

उत्तरप्रदेश -- धारा 441 के स्थान पर अग्रलिखित को प्रतिस्थापित करें, अर्थात् :-

441. आपराधिक अतिचार - जो कोई संपत्ति में या ऐसी संपत्ति पर जो किसी दूसरे के कब्जे में है, इस आशय से प्रवेश करता है कि वह कोई अपराध करे, जिसके कब्जे में ऐसी संपत्ति है, उसे अभित्रस्त, अपमानित या क्षुब्ध करे अथवा ऐसी संपत्ति में या ऐसी संपत्ति पर विधिपूर्वक प्रवेश करके वह विधिविरुद्ध रूप से इस आशय में बना रहता है कि एतद्द्वारा वह किसी ऐसे व्यक्ति को अभित्रस्त, अपमानित या क्षुब्ध करे या इस आशय से बना रहता है कि कोई अपराध करे, अथवा आपराधिक कानून (यू.पी. संशोधन) अधिनियम 1981 के पूर्व या प्रभाव में आने के बाद ऐसी संपत्ति में या ऐसी संपत्ति पर अनधिकृत कब्जा प्राप्त करने या ऐसी संपत्ति का अनधिकृत उपयोग करने के आशय से संपत्ति में या संपत्ति पर प्रवेश कर चुका है। दूसरे व्यक्ति द्वारा लिखित में सूचना पत्र द्वारा जो सम्यक् रूप से उस पर तामील हो चुका है, कहे जाने पर सूचना पत्र में दी गई तिथि तक ऐसी संपत्ति से हटने या उसका कब्जा या उपयोग करना छोड़ने में असफल रहता है, तब वह आपराधिक अतिचार करता है, यह कहा जाता है।
