Section 91 of IPC 1860:-  Exclusion of acts which are offences independently of harm caused -

The exceptions in sections 87, 88 and 89 do not extend to acts which are offences independently of any harm which they may cause, or be intended to cause, or be known to be likely to cause, to the person giving the consent, or on whose behalf the consent is given.

Illustration -

Causing miscarriage (unless caused in good faith for the purpose of saving the life of the woman) is an offence independently of aany harm which it may cause or be intended to cause to the woman. Therefore, it is not an offence "by reason of such harm"; and the consent of the woman or of her guardian to the causing of such miscarriage does not justify the act.

आईपीसी, 1860 (भारतीय दंड संहिता) की धारा 91 का विवरण -  ऐसे कार्यों का अपवर्जन जो कारित अपहानि के बिना भी स्वतः अपराध है -

धारा 87, 88 और 89 के अपवादों का विस्तार उन कार्यों पर नहीं है जो उस अपहानि के बिना भी स्वतः अपराध है जो उस व्यक्ति को, जो सम्मति देता है या जिसकी ओर से सम्मति दी जाती है, उन कार्यों से कारित हो, या कारित किए जाने का आशय हो, या कारित होने की सम्भाव्यता ज्ञात हो।

दृष्टांत -

गर्भपात कराना (जब तक कि वह उस स्त्री का जीवन बचाने के प्रयोजन से सद्भावपूर्वक कारित न किया गया हो) किसी अपहानि के बिना भी, जो उससे उस स्त्री को कारित हो या कारित करने का आशय हो, स्वतः अपराध है। इसलिए वह “ऐसी अपहानि के कारण" अपराध नहीं है; और ऐसा गर्भपात कराने की उस स्त्री की या उसके संरक्षक की सम्मति उस कार्य को न्यानुमत नहीं बनाती है।
