Ashok Kumar & Anr. vs State of Bihar - Supreme Court Important Judgment 2016 - 

 

On 21st October, 2016, in the case of Ashok Kumar & Anr. vs State of Bihar & Ors. [Civil Appeal No.9092 of 2012], wherein selections made by promotion from Class IV posts to Class III posts in the District Court of Muzaffarpur were under challenge, a three Judge Bench held that “if the appellants were aggrieved by the decision to hold a fresh process, they did not espouse their remedy. Instead, they participated in the fresh process of selection and it was only upon being unsuccessful that they challenged the result in the writ petition. This was clearly not open to the appellants. The principle of estoppel would operate.”
