 Section 7 The Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 in Hindi and English

Section 7 SC ST Act: “Forfeiture of property of certain persons”–

(1) Where a person has been convicted of any offence punishable under this Chapter, the Special Court may, in addition to awarding any punishment, by order in writing, declare that any property, movable or immovable or both, belonging to the person, which has been used for the commission of that offence, shall stand forfeited to Government. 

(2) Where any person is accused of any offence under this Chapter, it shall be open to the Special Court trying him to pass an order that all or any of the properties, movable or immovable or both, belonging to him, shall, during the period of such trial, be attached, and where such trial ends in conviction, the property so attached shall be liable to forfeiture to the extent it is required for the purpose of realisation of any fine imposed under this Chapter

Section 7 of SC ST Act 1989 in Hindi / अनुसूचित जाति और अनुसूचित जनजाति (अत्याचार निवारण) अधिनियम की धारा 7 का विवरण : कतिपय व्यक्तियों की संपत्ति का समपहरण-

(1) जहां कोई व्यक्ति इस अध्याय के अधीन दंडनीय किसी अपराध के लिए दोषसिद्ध किया गया है वहाँ विशेष न्यायालय, कोई दंड देने के अतिरिक्त, लिखित रूप में आदेश द्वारा, यह घोषित कर सकेगा कि उस व्यक्ति की कोई सम्पत्ति, स्थावर या जंगम या दोनों, जिनका उस अपराध को कले में प्रयोग किया गया है, सरकार को समपहृत हो जाएगी।

(2) जहां कोई व्यक्ति इस अध्याय के अधीन किसी अपराध का अभियुक्त है, वहां उसका विचारण करने वाला विशेष न्यायालय ऐसा आदेश कले के लिए स्वतन्त्र होगा कि उसकी सभी या कोई संपत्ति, स्थावर या जंगम या दोनों, ऐसे विचारण की अवधि के दौरान, कुर्क की जाएंगी और जहां ऐसे विचारण का परिणाम दोषसिद्धि है वहां इस प्रकार कुर्क की गई सम्पत्ति उस सीमा तक समपहरण के दायित्वाधीन होगी जहां तक वह इस अध्याय के अधीन अधिरोपित किसी जुर्माने की वसूली के प्रयोजन के लिए अपेक्षित है।
