Section 17 SC ST Act: “ Preventive action to be taken by the law and order machinery”–

(1) A District Magistrate or a Sub-divisional Magistrate or any other Executive Magistrate or any police officer not below the rank of a Deputy Superintendent of Police may, on receiving information and after such inquiry as he may think necessary, has reason to believe that a person or a group of persons not belonging to the Scheduled Castes or the Scheduled Tribes, residing in or frequenting any place within the local limits of his jurisdiction is likely to commit an offence or has threatened to commit any offence under this Act and is of the opinion that there is sufficient ground for proceeding, declare such an area to be an area prone to atrocities and take necessary action for keeping the peace and good behaviour and maintenance of public order and tranquility and may take preventive action. 

(2) The provisions of Chapters VIII, X and XI of the Code shall, so far as may be, apply for the purposes of sub-section (1). 

(3) The State Government may, by notification in the Official Gazette, make one or more schemes specifying the manner in which the officers referred to in sub-section (1) shall take appropriate action specified in such scheme or schemes to prevent atrocities and to restore the feeling of security amongst the members of the Scheduled Castes and the Scheduled Tribes.

Section 17 of SC ST Act 1989 in Hindi / अनुसूचित जाति और अनुसूचित जनजाति (अत्याचार निवारण) अधिनियम की धारा 17 का विवरण : विधि और व्यवस्था तंत्र द्वारा निवारक कार्यवाही

(1) यदि जिला मजिस्ट्रेट या उपखंड मजिस्ट्रेट या किसी अन्य कार्यपालक मजिस्ट्रेट या किसी पुलिस अधिकारी को, जो पुलिस उप अधीक्षक की पंक्ति से नीचे का न हो, इत्तिला प्राप्त होने पर और ऐसी जांच करने के पश्चात् जो वह आवश्यक समझे, यह विश्वास कले का कारण है कि किसी ऐसे व्यक्ति या ऐसे व्यक्तियों के समूह द्वारा, जो अनुसूचित जाति या अनुसूचित जनजाति के नहीं हैं, और जो उसकी अधिकारिता की स्थानीय सीमाओं के भीतर किसी स्थान पर निवास करते हैं या बार-बार आते जाते हैं, इस अधिनिमय के अधीन कोई अपराध कले की संभावना है या उन्होंने अपराध करने की धमकी दी है और उसकी यह राय है कि कार्यवाही कले के लिए पर्याप्त आधार है तो वह उस क्षेत्र को अत्याचार ग्रस्त क्षेत्र घोषित कर सकेगा तथा शांति और सदाचार बनाए रखने तथा लोक व्यवस्था और प्रशांति बनाए रखने के लिए आवश्यक कार्रवाई कर सकेगा और निवारक कार्रवाई कर सकेगा।

(2) संहिता के अध्याय 8, 10 और 11 के उपबंध जहां तक हो सके, उपधारा (1) के प्रयोजनों के लिए लागू होंगे

(3) राज्य सरकार, राजपत्र में, अधिसूचना द्वारा, एक या अधिक स्कीमें वह रीति विनिर्दिष्ट करते हुए बना सकेगी जिसमें उपधारा (1) में निर्दिष्ट अधिकारी अत्याचारों के निवारण के लिए तथा अनुसूचित जाति और अनुसूचित जनजाति के सदस्यों में सुरक्षा की भावना पुनः लाने के लिए ऐसी स्कीम या स्कीमों में विनिर्दिष्ट समुचित कार्रवाई करेंगे।
