Section 81 Negotiable Instruments Act, 1881 in Hindi and English 



Section 81 Negotiable Instruments Act, 1881 :(1) Any person liable to pay, and called upon by the holder thereof to pay, the amount due on a promissory note. bill of exchange or cheque is before payment entitled to have it shown, and is on payment entitled to have it delivered up, to him, or, if the instrument is lost or cannot be produced, to be indemnified against any further claim thereon against him.

(2) Where the cheque is an electronic image of a truncated cheque, even after the payment the banker who received the payment shall be entitled to retain the truncated cheque.

(3) A certificate issued on the foot of the printout of the electronic image of a truncated cheque by the banker who paid the instrument, shall be prima facie proof of such payment.]

परक्राम्य लिखत अधिनियम, 1881 की धारा 81का विवरण :  - (1) वचनपत्र, विनिमय-पत्र या चैक पर शोध्य रकम संदत करने का दायी और उसके धारक द्वारा संदाय के लिए अपेक्षित किया गया कोई भी व्यक्ति संदाय से पूर्व इस बात का हकदार है कि वह उसे दिखाया जाए तथा संदाय कर दिए जाने पर इस बात का हकदार है कि वह उसे परिदत्त कर दिया जाए अथवा यदि लिखत खो गई है या पेश नहीं की जा सकती तो इस बात का हकदार है कि उस लिखत के आधार पर उसके विरुद्ध किसी आगे के दावे की बाबत् उसकी क्षतिपूर्ति की जाए ।

(2) जब चैक इलेक्ट्रानिक रूपक छंटित चैक है तब भी अदायगी के बाद भी बैंकार जिसने अदायगी प्राप्त किया है, छंटित चैक को रोकने के लिये अधिकारी होगा ।

(3) बैंकार के द्वारा इलेक्ट्रानिक रूपक का छंटित चैक के नीचे के भाग में एक प्रमाण-पत्र जारी किया जायेगा कि लिखत की अदायगी जिसने किया, ऐसी अदायगी का प्रथम दृष्टया प्रमाण होगा ।
