Section 72 The Army Act, 1950 in Hindi and English 



Section 72 The Army Act, 1950  :Alternative punishments awardable by court- martial. Subject to the provisions of this Act, a court- martial may, on convicting a person subject to this Act of any of the offences specified in sections 34 to 68 inclusive, award either the particular punishment with which the offence is stated in the said sections to be punishable, or, in lieu thereof, any one of the punishments lower in the scale set out in section 71, regard being had to the nature and degree of the offence.

सेना अधिनियम, 1950 की धारा 72 का विवरण :  - सेना-न्यायालय द्वारा अधिनिर्णेय आनुकल्पिक दण्ड - इस अधिनियम के उपबन्धों के अध्यधीन रहते हुए यह है कि सेना-न्यायालय इस अधिनियम के अध्यधीन के उस व्यक्ति को, धाराओं 34 से 68 तक में, जिनके अन्तर्गत ये दोनों धाराएं भी आती हैं, विनिर्दिष्ट अपराधों में से किसी का सिद्धदोष ठहराने पर, या तो वह विशिष्ट दण्ड जिससे उक्त धाराओं में वह अपराध दण्डनीय कथित है, या उसके बदले में धारा 71 में दिए गए मापमान में के दण्डों में से कोई निम्नतर दण्ड अपराध की प्रकृति और मात्रा को ध्यान में रखते हुए, अधिनिर्णीत कर सकेगा।
