Section 70 The Army Act, 1950  :Civil offence not triable by court- martial. A person subject to this Act who commits an offence

of murder against a person not subject to military, naval or air force law, or of culpable homicide not

amounting to murder against such a person or of rape in relation to such a person, shall not be

deemed to be guilty of an offence against this Act and shall not be tried by a court- martial, unless he

commits any of the said offences-

(a) while on active service, or

(b) at any place outside India, or

(c) at a frontier post specified by the Central Government by notification in this behalf. 1[ CHAP

सेना अधिनियम, 1950 की धारा 70 का विवरण :  - सिविल अपराध जो सेना-न्यायालय द्वारा विचारणीय नहीं हैं - इस अधिनियम के अध्यधीन का कोई व्यक्ति, जो ऐसे व्यक्ति के विरुद्ध जो सैनिक, नौसैनिक या वायु सेना विधि के अध्यधीन नहीं है, हत्या का या ऐसे व्यक्ति के विरुद्ध, हत्या की कोटि में न आने वाले आपराधिक मानव वध का या ऐसे व्यक्ति से बलात्संग करने का अपराध करेगा इस अधिनियम के विरुद्ध किसी अपराध का दोषी तब के सिवाय न समझा जाएगा और सेना-न्यायालय द्वारा उसका विचारण तब के सिवाय नहीं किया जाएगा जब कि वह उक्त अपराधों में से कोई अपराध -

(क) सक्रिय सेवा पर रहते समय करता है, अथवा

(ख) भारत के बाहर किसी स्थान पर करता है, अथवा

(ग) ऐसी सीमांत चौकी पर करता है जो केन्द्रीय सरकार द्वारा इस निमित्त अधिसूचना द्वारा विनिर्दिष्ट की गई हो।
