Section 64 The Army Act, 1950  :. Miscellaneous offences. Any person subject to this Act who commits any of the following

offences, that is to say,-

(a) being in command at any post or on the march, and receiving a complaint that any one under his

command has beaten or otherwise maltreated or oppressed any person, or has disturbed any fair or

market, or committed any riot or trespass, fails to have due reparation made to the injured person or to

report the case to the proper authority; or

(b) by defiling any place of worship, or otherwise, intentionally insults the religion or wounds the

religious feelings of any person; or

(c) attempts to commit suicide, and in such attempt does any act towards the commission of such

offence; or

(d) being below the rank of warrant officer, when off duty, appears without proper authority, in or about

camp or cantonments, or in or about, or when going to or returning from, any town or bazar, carrying a

rifle, sword or other offensive weapon; or

(e) directly or indirectly accepts or obtains, or agrees to accept or attempts to obtain, for himself or for

any other person, any gratification as a motive or reward for procuring the enrolment' of any person, or

leave of absence, promotion or any other advantage or indulgence for any person in the service; or

(f) commits any offence against the property or person of any inhabitant of, or resident in, the country

in which he is serving; shall, on conviction by court- martial, be liable to suffer imprison- ment for a

term which may extend to seven years or such less punishment as is in this Act mentioned.

सेना अधिनियम, 1950 की धारा 64 का विवरण :  - प्रकीर्ण अपराध - इस अधिनियम के अध्यधीन का कोई व्यक्ति, जो निम्नलिखित अपराधों में से कोई भी अपराध करेगा, अर्थात् :

(क) किसी चौकी पर या प्रगमन पर समादेशन करते हुए यह परिवाद प्राप्त होने पर कि उसके समादेश के अधीन के किसी व्यक्ति ने किसी व्यक्ति को पीटा है या उसके साथ अन्यथा बुरा बर्ताव किया है या उसे सताया है या किसी मेले या बाजार में विघ्न डाला है या कोई बल्वा या अत्याचार किया है, क्षतिग्रस्त व्यक्ति की सम्यक् हानि पूर्ति कराने या मामले की रिपोर्ट उचित प्राधिकारी से करने में असफल रहेगा ; अथवा

(ख) पूजा के किसी स्थान को अपवित्र करके या अन्यथा किसी व्यक्ति के धर्म का साशय अपमान करेगा या उसकी धार्मिक भावनाओं को ठेस पहुंचाएगा ; अथवा

(ग) आत्महत्या करने का प्रयत्न करेगा और ऐसा प्रयत्न करने में उस अपराध के किए जाने की दशा में कोई कार्य करेगा ; अथवा

(घ) वारण्ट आफिसर के रैंक से नीचे का होते हुए, जब वह कर्तव्य पर न हो, तब कैम्प या छावनियों में या के आसपास या किसी नगर या बाजार में या के आसपास या किसी नगर या बाजार को जाते हुए या उससे वापस आते हुए, कोई राइफल, तलवार या अन्य आक्रामक शस्त्र ले जाते हुए उचित प्राधिकार के बिना देखा जाएगा ; अथवा

(ङ) किसी व्यक्ति के अभ्यावेशन या सेवा में के किसी व्यक्ति के लिए अनुपस्थिति छुट्टी, प्रोन्नति या कोई अन्य फायदा या अनुग्रह उपाप्त कराने के लिए हेतु, या इनाम के रूप में कोई परितोषण अपने लिए या किसी अन्य व्यक्ति के लिए प्रत्यक्षतः या अप्रत्यक्षतः प्रतिगृहीत करेगा या अभिप्राप्त करेगा या प्रतिगृहीत करने के लिए सहमत होगा या अभिप्राप्त करने का प्रयत्न करेगा ; अथवा

(च) उस देश के, जिसमें वह सेवा कर रहा है, किसी वासी या निवासी की सम्पत्ति या उसके शरीर के विरुद्ध कोई अपराध करेगा,

सेना-न्यायालय द्वारा दोषसिद्धि पर कारावास, जिसकी अवधि सात वर्ष तक की हो सकेगी, या ऐसा लघुतर दंड, जो इस अधिनियम में वर्णित है, भोगने के दायित्व के अधीन होगा।
