Section 54 The Army Act, 1950  :Making away with equipment. Any person subject to this Act who commits any of the following

offences, that is to say,-

(a) makes away with, or is concerned in making away with, any arms, ammunition, equipment,

instruments. tools, clothing or any other thing being the property of the Government issued to him for

his use or entrusted to him; or

(b) loses by neglect anything mentioned in clause (a); or

(c) sells, pawns, destroys or defaces any medal or decoration granted to him;

shall, on conviction by court- martial, be liable to suffer imprison- ment for a term which may extend in

the case of the offences specified in clause (a) to ten years, and in the case of the offences specified

in the other clauses to five years, or such less punishment as is in this Act mentioned.

सेना अधिनियम, 1950 की धारा 54 का विवरण :  - उपस्कर को गायब कर देना - इस अधिनियम के अध्यधीन का कोई व्यक्ति जो निम्नलिखित अपराधों में से कोई अपराध करेगा, अर्थात्:-

(क) किन्हीं आयुधों, गोलाबारुद्ध, उपस्कर, उपकरणों, औजारों, कपड़ों या किसी अन्य वस्तु को, जो सरकार की सम्पत्ति होते हुए उसे अपने उपयोग के लिए दी हुई हो या उसे न्यस्त की हुई हो, गायब कर देगा या गायब करवा देने में सम्पृक्त होगा, अथवा

(ख) खंड (क) में वर्णित किसी वस्तु को उपेक्षा से गंवा देगा, अथवा

(ग) अपने को अनुदत्त किसी पदक या अलंकरण को बेचेगा, गिरवी रखेगा, नष्ट करेगा या विरूपित करेगा,

सेना-न्यायालय द्वारा दोषसिद्धि पर कारावास, जिसकी अवधि खंड (क) में विनिर्दिष्ट अपराधों की दशा में दस वर्ष तक की और अन्य खंडों में विनिर्दिष्ट अपराधों की दशा में पांच वर्ष तक की हो सकेगी, या ऐसा लघुतर दंड, जो इस अधिनियम में वर्णित है, भोगने के दायित्व के अधीन होगा।
