Section 51 Negotiable Instruments Act, 1881 :Every sole maker. drawer, payee or indorsee, or all of several joint makers, drawers, payees or indorsees, of a negotiable instrument may, if the negotiability of such instrument has not been restricted or excluded as mentioned in section 50, indorse and negotiate the same.

Explanation -- Nothing in this section enables a maker or drawer to indorse or negotiate an instrument, unless he is in lawful possession or is holder thereof; or enables a payee or indorsee to indorse or negotiate an instrument, unless he is holder thereof.

Illustration

A bill is drawn payable to A or order. A indorses it to B, the indorsement not containing the words “or order" or any equivalent words. B may negotiate the instrument.

परक्राम्य लिखत अधिनियम, 1881 की धारा 51 का विवरण :  - परक्राम्य लिखत का हर एकल रचयिता, लेखीवाल, पानेवाला या पृष्ठांकिती या कई संयुक्त रचयिताओं, लेखीवालों, पानेवालों या पृष्ठांकितियों में से सब उसे पृष्ठांकित और

परक्रामित कर सकेंगे यदि ऐसी लिखत की परक्राम्यता धारा 50 में वर्णित रूप में निर्बन्धित या अपवर्जित नहीं की गई है ।

स्पष्टीकरण -- इस धारा में की कोई भी बात रचयिता या लेखीवाल को लिखत को पृष्ठांकित करने या परक्रामित करने के लिए समर्थ नहीं बनाती जब तक कि वह उस पर विधिपूर्ण कब्जा न रखता हो या बह उसका धारक न हो, और न वह पाने वाले या पृष्ठांकिती को, लिखत को पृष्ठांकित या परक्रामित करने के लिए समर्थ बनाती है, जब तक कि वह उसका धारक न हो ।

दृष्टान्त

विनिमय-पत्र क को या आदेशानुसार देय लिखा गया है । क उसे ख के नाम पृष्ठांकित करता है । पृष्ठांकन में "या आदेशानुसार'' शब्द या कोई समतुल्य शब्द अन्तर्विष्ट नहीं है । ख लिखत को परक्रामित कर सकेगा ।
