Section 46  The Army Act, 1950  :Certain forms of disgraceful conduct. Any person subject to this Act who commits any of the

following offences, that is to say,-

(a) is guilty of any disgraceful conduct of a cruel, indecent or unnatural kind; or

(b) malingers, or feigns, or produces disease or infirmity in himself, or intentionally delays his cure or

aggravates his disease or infirmity; or

(c) with intent to render himself or any other person unfit for service, voluntarily causes hurt to himself

or that person; shall, on conviction by court- martial, be liable to suffer imprisonment for a term which

may extend to seven years or such less punishment as is in this Act mentioned.

सेना अधिनियम, 1950 की धारा 46  का विवरण :  - कलंकास्पद आचरण के कतिपय प्रकार - इस अधिनियम के अध्यधीन का कोई व्यक्ति जो निम्नलिखित अपराधों में से कोई अपराध करेगा, अर्थात्

(क) क्रूर, अशिष्ट या अप्राकृतिक प्रकार के किसी कलंकास्पद आचरण का दोषी होगा, अथवा

(ख) कर्तव्य से बचने के लिए रोगी बन जाएगा या अपने में रोग या अंगशैथिल्य का ढोंग करेगा या अपने में उसे उत्पन्न करेगा या निरोग होने में साशय विलम्ब करेगा या अपने रोग या अंगशैथिल्य को गुरुतर बनाएगा, अथवा

(ग) अपने आपको या किसी अन्य व्यक्ति को सेवा के अयोग्य बनाने के आशय से अपने आपको या उस व्यक्ति को स्वेच्छा उपहति कारित करेगा, सेना-न्यायालय द्वारा दोषसिद्धि पर कारावास, जिसकी अवधि सात वर्ष तक की हो सकेगी या ऐसा लघुतर दंड, जो इस अधिनियम में वर्णित है, भोगने के दायित्व के अधीन होगा।
