Section 42 The Army Act, 1950  :Insubordination and obstruction. Any person subject to this Act who commits any of the

following offences, that is to say,-

(a) being concerned in any quarrel, affray, or disorder, refuses to obey any officer, though of inferior

rank, who orders him into arrest, or uses criminal force to or assaults any such officer; or

(b) uses criminal force to, or assaults any person, whether subject to this Act or not, in whose custody

he is lawfully placed, and whether he is or is not his superior officer; or

(c) resists an escort whose duty it is to apprehend him or to have him in charge; or

(d) breaks out of barracks, camp or quarters; or

(e) neglects to obey any general, local or other order; or

(f) impedes the provost- marshal or any person lawfully acting on his behalf, or when called upon,

refuses to assist in the execution of his duty a provost- marshal or any person lawfully acting on his

behalf; or

(g) uses criminal force to or assaults any person bringing provisions or supplies to the forces; shall, on

conviction by court- martial, be liable to suffer imprison- ment for a term which may extend, in the case

of the offences specified in clauses (d) and (e) to two years, and in the case of the offences specified

in the other clauses to ten years or such less punishment as is in this Act mentioned.

सेना अधिनियम, 1950 की धारा 42 का विवरण :  - अनधीनता और बाधा - इस अधिनियम के अध्यधीन का कोई व्यक्ति, जो निम्नलिखित अपराधों में से कोई अपराध करेगा, अर्थात्

(क) किसी झगड़े, दंगे या उपद्रव से संपृक्त होते हुए, किसी ऐसे आफिसर की, भले ही वह निम्नतर रैंक का हो, जो उसकी गिरफ्तारी का आदेश देता है, आज्ञापालन से इन्कार करेगा या ऐसे आफिसर पर आपराधिक बल का प्रयोग करेगा या हमला करेगा, अथवा

(ख) किसी ऐसे व्यक्ति पर अपराधिक बल का प्रयोग करेगा या हमला करेगा जिसकी अभिरक्षा में उसे विधिपूर्वक रखा गया है चाहे वह व्यक्ति इस अधिनियम के अध्यधीन हो या न हो और चाहे उसका वरिष्ठ आफिसर हो या न हो, अथवा

(ग) ऐसे अनुरक्षक का प्रतिरोध करेगा जिसका कर्तव्य उसे पकड़ना या अपने भारसाधन में लेना है, अथवा (घ) बैरकों, कैम्प या क्वार्टरों में अनधिकृत रूप से निकलेगा, अथवा (ङ) किसी साधारण, स्थानीय या अन्य आदेश के पालन की उपेक्षा करेगा, अथवा

(च) प्रोवो-मार्शल के या उसकी ओर से विधिपूर्वक कार्य करने वाले किसी व्यक्ति के समक्ष अड़चन डालेगा या प्रोवोमार्शल या उसकी ओर से विधिपूर्वक कार्य करने वाले किसी व्यक्ति-निष्पादन में उसकी सहायता की अपेक्षा की जाने पर उससे इन्कार करेगा, अथवा

(छ) किसी ऐसे व्यक्ति पर जो बल के लिए रसद या प्रदाय ला रहा हो अपराधिक बल का प्रयोग करेगा या हमला करेगा, सेना-न्यायालय द्वारा दोषसिद्धि पर कारावास, जिसकी अवधि उन अपराधों की दशा में जो खंड (घ) और (ङ) में विनिर्दिष्ट हैं, दो वर्ष तक की, और उन अपराधों की दशा में, जो अन्य खंडों में विनिर्दिष्ट हैं, दस वर्ष तक की हो सकेगी या ऐसा लघुतर दंड, जो इस अधिनियम में वर्णित है, भोगने के दायित्व के अधीन होगा।
