Section 36 The Army Act, 1950  :Offences punishable more severely on active service than at other times. Any person subject

to this Act who commits any of the following offences, that is to say,-

(a) forces a safeguard, or forces or uses criminal force to a sentry; or

(b) breaks into any house or other place in search of plunder; or

(c) being a sentry sleeps upon his post, or is intoxicated; or

(d) without orders from his superior officer leaves his guard, picquet, patrol or post; or

(e) intentionally or through neglect occasions a false alarm in camp, garrison, or quarters; or spreads

reports calculated to create unnecessary alarm or despondency; or

(f) makes known the parole, watchword or countersign to any person not entitled to receive it; or

knowingly gives a parole, watchword or countersign different from what he received; shall, on

conviction by court- martial, if he commits any such offence when on active service, be liable to suffer

imprisonment for a term which may extend to fourteen years or such less punishment as is in this Act

mentioned; and if he commits any such offence when not on active service, be liable to suffer

imprisonment for a term which may extend to seven years or such less punishment as is in this Act

mentioned.

सेना अधिनियम, 1950 की धारा 36 का विवरण :  - अन्य समयों की अपेक्षा सक्रिय सेवा के समय अधिक कठोरता से दण्डनीय अपराध - इस अधिनियम के अध्यधीन का कोई भी व्यक्ति, जो निम्नलिखित अपराधों में से कोई अपराध करेगा, अर्थात् -

(क) किसी संरक्षण गारद का अतिक्रमण करेगा या किसी सन्तरी का अतिक्रमण करेगा या उस पर आपराधिक बल का प्रयोग करेगा, अथवा

(ख) लूट-पाट की तलाश में किसी गृह या अन्य स्थान में अनधिकृत प्रवेश करेगा, अथवा

(ग) सन्तरी होते हुए अपने पदस्थान पर सो जाएगा या नशे में होगा, अथवा

(घ) अपने वरिष्ठ आफिसर के आदेशों के बिना गारद, पिकेट, पैट्रोल या पदस्थान छोड़ेगा, अथवा

(ङ) कैम्प, गैरिजन या क्वार्टरों में मिथ्या एलार्म साशय या उपेक्षा से कारित करेगा, फैलाएगा या ऐसी रिपोर्ट जो अनावश्यक एलार्म या नैराश्य पैदा करने के लिए प्रकल्पित हो, फैलाएगा, अथवा

(च) पैरोल, संकेत-शब्द या प्रतिसंकेत किसी ऐसे व्यक्ति को जो उसे जानने का हकदार नहीं है, बताएगा या जो पैरोल, संकेत-शब्द या प्रतिसंकेत उसे बताया गया है उससे भिन्न पैरोल, संकेत-शब्द या प्रतिसंकेत जानते हुए देगा,

सेना न्यायालय द्वारा दोषसिद्धि पर -

उस दशा में, जिसमें कि ऐसा कोई अपराध वह तब करेगा, जब वह सक्रिय सेवा पर है कारावास, जिसकी अवधि चौदह वर्ष तक की हो सकेगी, या ऐसा लघुतर दंड, जो इस अधिनियम में वर्णित है, भोगने के दायित्व के अधीन होगा, तथा

उस दशा में जिसमें ऐसा कोई अपराध वह तब करेगा जब तक वह सक्रिय सेवा पर नहीं है कारावास, जिसकी अवधि सात वर्ष तक की हो सकेगी, या ऐसा लघुतर दंड, जो इस अधिनियम में वर्णित है, भोगने के दायित्व के अधीन होगा।
