Section 24 The Army Act, 1950  :Discharge or dismissal when out of India.

(1) Any person enrolled under this Act who is entitled under the conditions of his enrolment to be

discharged, or whose discharge is ordered by competent authority, and who, when he is so entitled or

ordered to be discharged, is serving out of India, and requests to be sent to India, shall, before being

discharged, be sent to India with all convenient speed.

(2) Any person enrolled under this Act who is dismissed from the service and who, when he is so

dismissed, is serving out of India, shall be sent to India with all convenient speed.

(3) Where any such person as is mentioned in sub- section (2) is sentenced to dismissal combined

with any other punishment, such other punishment, or, in the case of a sentence of transportation or

imprisonment, a portion of such sentence may be inflicted before he is sent to India.

(4) For the purposes of this section, the word" discharge" shall' include release, and the word"

सेना अधिनियम, 1950 की धारा 24 का विवरण :  - भारत से बाहर होने की स्थिति में उन्मोचन या पदच्यति - (1) इस अधिनियम के अधीन अभ्यावेशित किया गया कोई भी व्यक्ति, जो अपने अभ्यावेशन की शर्तों के अधीन उन्मोचित किए जाने का हकदार है या जिसका उन्मोचन सक्षम प्राधिकारी द्वारा आदिष्ट किया गया है और जो उन्मोचित किए जाने के लिए ऐसे हकदार या आदिष्ट होने के समय भारत के बाहर सेवा कर रहा है, और भारत भेजे जाने की प्रार्थना करता है, उन्मोचित किए जाने के पहले सुविधानुसार पूर्ण शीघ्रता से भारत भेज दिया जाएगा।

(2) इस अधिनियम के अधीन अभ्यावेशित किया गया कोई भी व्यक्ति, जो सेवा से पदच्युत किया जाता है और जो ऐसे पदच्युत किए जाने के समय भारत के बाहर सेवा कर रहा है, सुविधानुसार पूर्ण शीघ्रता से भारत भेज दिया जाएगा।

(3) जहां कि कोई ऐसा व्यक्ति, जो उपधारा (2) में वर्णित है, किसी अन्य दण्ड के साथ-साथ पदच्युति से दण्डादिष्ट किया जाता है वहां ऐसा अन्य दण्ड अथवा निर्वासन या कारावास के दण्डादेश की दशा में, ऐसे दण्डादेश का कोई प्रभाग उसे भारत भेजे जाने से पहले भुगतवाया जा सकेगा।

(4) इस धारा के प्रयोजनों के लिए “उन्मोचन” शब्द के अन्तर्गत निर्मुक्ति आएगी और “पदच्युति” शब्द के अन्तर्गत हटाया जाना आएगा।
