Section 88A Motor Vehicles Act, 1988 in Hindi and English

Section 88A of MV Act 1988 :-  Power of Central Government to make schemes for national, multimodal and inter-State transport of passengers and goods -- (1) Notwithstanding anything contained in this Act, the Central Government may, by passengers, and issue or modify licences under such scheme for the following purposes, namely :-

(a) last mile connectivity;

(b) rural transport;

(c) improving the movement of freight, and logistics;

(d) better utilisation of transportation assets;

(e) the enhancement to the economic vitality of the area, especially by enabling competitiveness, productivity and efficiency;

(f) the increase in the accessibility and mobility of people;

(g) the protection and enhancement of the environment;

(h) the promotion of energy conservation;

(i) improvement of the quality of life;

(j) enhancement of the integration and connectivity of the transportation system, across and between modes of transport; and

(k) such other matters as the Central Government may deem fit :

Provided that the Central Government may, before taking any action under this sub-section consult the State Governments.

(2) Notwithstanding anything contained in sub-section (1), two or more States may make schemes for the operation within such States for the inter-State transportation of goods or passengers :

Provided that in the event of any repugnancy between the schemes made by the Central Government under sub-section (1) and schemes made by two or more States under this sub-section, the schemes made under sub-section (1) shall prevail.

मोटर यान अधिनियम, 1988 की धारा 88क का विवरण :  -   केन्द्रीय सरकार की राष्ट्रीय, मल्टी माडल और अंतर्राज्य यात्रियों और मालों के परिवहन के लिए स्कीमें बनाने की शक्ति -- (1) इस अधिनियम में अंतर्विष्ट किसी बात के होते हुए भी केन्द्रीय सरकार राजपत्र में अधिसूचना द्वारा इस अधिनियम के अधीन जारी किसी परमिट को उपांतरित कर सकेगी या राष्ट्रीय, मल्टी माडल और माल या यात्रियों के अंतर्राज्य परिवहन के लिए स्कीमें बना सकेगी तथा निम्नलिखित प्रयोजनों के लिए ऐसी स्कीम के अधीन अनुज्ञप्तियां जारी कर सकेगी या उपांतरित कर सकेगी, अर्थात् :-

(क) अंतिम स्थान को संपर्क; 

(ख) ग्रामीण परिवहन;

(ग) माल और लाजिस्टिक के संचलन में सुधार;

(घ) परिवहन आस्तियों का बेहतर उपयोग;

(ङ) प्रतिस्पर्धा, उत्पादकता और दक्षता के माध्यम से क्षेत्र की आर्थिक ओजस्विता का वर्धन;

(च) लोगों की पहुंच और सचलता में वृद्धि;

(छ) पर्यावरण का संरक्षण और वर्धन;  

(ज) ऊर्जा संरक्षण का संवर्धन;

(झ) जीवन की क्वालिटी में सुधार;

(ञ) परिवहन के तरीकों में और उनमें परिवहन प्रणाली के एकीकरण और संपर्क का वर्धन;  और

(ट) ऐसे अन्य विषय, जिन्हें केन्द्रीय सरकार उचित समझे :  

परंतु केन्द्रीय सरकार इस उपधारा के अधीन कोई कार्रवाई करने से पूर्व राज्य सरकारों से परामर्श करेगी।

(2) उपधारा (1) में अंतर्विष्ट किसी बात के होते हुए भी दो या अधिक राज्य मालों या परिवहन के ऐसे राज्यों में प्रचालन के लिए स्कीमें बना सकेंगे :

परंतु केन्द्रीय सरकार द्वारा उपधारा (1) के अधीन बनाई गई स्कीमों और दो या अधिक राज्यों द्वारा इस उपधारा के अधीन बनाई गई स्कीम में प्रतिकूलता की दशा में उपधारा (1) के अधीन बनाई गई स्कीमें अभिभावी होंगी ।
