Section 320 of CrPC 1973 :- When the person who would otherwise be competent to compound an offence under this section is under the age of eighteen years or is an idiot or a lunatic, any person competent to contract on his behalf, may, with the permission of the Court compound such offence.

When the person who would otherwise be competent to compound an offence under this section is dead, the legal representative, as defined in the Code of Civil Procedure, 1908 (5 of 1908) of such person may, with the consent of the Court compound such offence.

5. When the accused has been committed for trial or when he has been convicted and an appeal is pending no composition for the offence shall be allowed without the leave of the Court to which he is committed, or, as the case may be, before which the appeal is to be heard.

6. A High Court or Court of Session acting in the exercise of its powers of revision under section 401 may allow any person to compound any offence which such person is competent to compound under this section.

7. No offence shall be compounded if the accused is, by reason of a previous conviction, liable either to enhanced punishment or to a punishment of a different kind for such offence.

8. The composition of an offence under this section shall have the effect of an acquittal of the accused with whom the offence has been compounded.

9. No offence shall be compounded except as provided by this section.

दंड प्रक्रिया संहिता 1973 की धारा 320 का विवरण :  -  320. अपराधों का शमन --

(1) नीचे दी गई सारणी के प्रथम दो स्तंभों में विनिर्दिष्ट भारतीय दण्ड संहिता (1860 का 45) की धाराओं के अधीन दण्डनीय अपराधों का शमन उस सारणी के तृतीय स्तम्भ में उल्लिखित व्यक्तियों द्वारा किया जा सकता है :

(3) जब इस धारा के अधीन कोई अपराध शमनीय है, तो ऐसे अपराध का दुष्प्रेरण या ऐसे अपराध को कारित करने का प्रयास (जब ऐसा प्रयास अपने आप में एक अपराध है) या जहाँ अभियुक्त भारतीय दण्ड संहिता (1860 का 45) की धारा 34 या 149 के अधीन दायी है, का उसी प्रकार से शमन किया जा सकेगा।

(4) (क) जब वह व्यक्ति, जो इस धारा के अधीन अपराध का शमन करने के लिए अन्यथा सक्षम होता, अठारह वर्ष से कम आयु का है या जड़ या पागल है तब कोई व्यक्ति जो उसकी ओर से संविदा करने के लिए सक्षम हो, न्यायालय की अनुज्ञा से, ऐसे अपराध का शमन कर सकता है।

(ख) जब वह व्यक्ति, जो इस धारा के अधीन अपराध का शमन करने के लिए अन्यथा सक्षम होता, मर जाता है तब ऐसे व्यक्ति का, सिविल प्रक्रिया संहिता, 1908 (1908 का 5) में यथापरिभाषित, विधिक प्रतिनिधि, न्यायालय की सम्मति से, ऐसे अपराध का शमन कर सकता है। 

(5) जब अभियुक्त विचारणार्थ सुपुर्द कर दिया जाता है या जब वह दोषसिद्ध कर दिया जाता है और अपील लंबित है, तब अपराध का शमन, यथास्थिति, उस न्यायालय की इजाजत के बिना अनुज्ञात न किया जाएगा जिसे वह सुपुर्द किया गया है, या जिसके समक्ष अपील सुनी जानी है।

(6) धारा 401 के अधीन पुनरीक्षण की अपनी शक्तियों के प्रयोग में कार्य करते हुए उच्च न्यायालय या सेशन न्यायालय किसी व्यक्ति को किसी अपराध का शमन करने की अनुज्ञा दे सकता है जिसका शमन करने के लिए वह व्यक्ति इस धारा के अधीन सक्षम है |

(7) यदि अभियुक्त पूर्व दोषसिद्धि के कारण किसी अपराध के लिए या तो वर्धित दण्ड से या भिन्न किस्म के दण्ड से दण्डनीय है तो ऐसे अपराध का शमन न किया जाएगा।

(8) अपराध के इस धारा के अधीन शमन का प्रभाव उस अभियुक्त की दोषमुक्ति होगा जिससे अपराध का शमन किया गया है |

(9) अपराध का शमन इस धारा के उपबंधों के अनुसार ही किया जाएगा, अन्यथा नहीं।
