Section 64 of IPC 1860:-Sentence of imprisonment for non-payment of fine -

In every case, of an offence punishable with imprisonment as well as fine, in which the offender is sentenced to a fine, whether with or without imprisonment,

and in every case of an offence punishable '[with imprisonment or fine, or] with fine only, in which the offender is sentenced to a fine,

it shall be competent to the Court which sentences such offender to direct by the sentence that, in default of payment of the fine, the offender shall suffer imprisonment for a certain term, in which imprisonment shall be in excess of any other imprisonment to which he may have been sentenced or to which he may be liable under a commutation of a sentence.

आईपीसी, 1860 (भारतीय दंड संहिता) की धारा 64 का विवरण - जुर्माना न देने पर कारावास का दण्डादेश -

कारावास और जुर्माना दोनों से दण्डनीय अपराध के हर मामले में; जिसमें अपराधी कारावास सहित या रहित, जुर्माने से दण्डादिष्ट हुआ है, तथा कारावास या जुर्माने अथवा केवल जुर्माने से दण्डनीय अपराध के हर मामले में, जिसमें अपराधी जुर्माने से दण्डादिष्ट हुआ है,

वह न्यायालय, जो ऐसे अपराधी को दण्डादिष्ट करेगा, सक्षम होगा कि दण्डादेश द्वारा निदेश दे कि जुर्माना देने में व्यतिक्रम होने की दशा में, अपराधी अमुक अवधि के लिए कारावास भोगेगा जो कारावास उस अन्य कारावास के अतिरिक्त होगा, जिसके लिए वह दण्डादिष्ट हुआ है या जिससे वह दण्डादेश के लघुकरण पर दण्डनीय है।
