Section 53A of IPC 1860:-“Offence” –Construction of reference to transportation -

(1) Subject to the provisions of sub-section (2) and sub-section (3), any reference to “transportation for life” in any other law for the time being in force or in any instrument or order having effect by virtue of any such law or of any enactment repealed shall be construed as a reference to "imprisonment for life”.

(2) In every case in which a sentence of transportation for a term has been passed before the commencement of the Code of Criminal Procedure (Amendment) Act, 1955 (26 of 1955), the offender shall be dealt with in the same manner as if sentenced to rigorous imprisonment for the same term.

(3) Any reference to transportation for a term or to transportation for any shorter term (by whatever name called) in any other law for the time being in force shall be deemed to have been omitted.

(4) Any reference to "transportation" in any other law for the time being in force shall -

(a) if the expression means transportation for life, be construed as a reference to imprisonment for life;

(b) if the expression means transportation for any shorter term, be deemed to have been omitted.

आईपीसी, 1860 (भारतीय दंड संहिता) की धारा 53क का विवरण -  निर्वासन के प्रति निर्देश का अर्थ लगाना -

(1) उपधारा (2) के और उपधारा (3) के उपबंधों के अध्यधीन किसी अन्य तत्समय प्रवृत्ति विधि में, या किसी ऐसी विधि या किसी निरसित अधिनियमिति के आधार पर प्रभावशील किसी लिखत या आदेश में “आजीवन निर्वासन” के प्रति निर्देश का अर्थ यह लगाया जायेगा, कि वह “आजीवन कारावास” के प्रति निर्देश है।

(2) हर मामले में, जिसमें कि किसी अवधि के लिए निर्वासन का दण्डादेश दण्ड प्रक्रिया संहिता (संशोधन) अधिनियम, 1955 (1955 का 26) के प्रारंभ से पूर्व दिया गया है, अपराधी से उसी प्रकार बरता जाएगा, मानो वह उस अवधि के लिए कठिन कारावास के लिए दण्डादिष्ट किया गया हो।

(3) किसी अन्य तत्समय प्रवृत्त विधि में किसी अवधि के लिए निर्वासन या किसी लघुतर अवधि के लिए निर्वासन के प्रति (चाहे उसे कोई भी नाम दिया गया हो) कोई निर्देश लुप्त कर दिया गया समझा जाएगा।

(4) किसी अन्य तत्समय प्रवृत्त विधि में निर्वासन के प्रति जो कोई निर्देश हो -

(क) यदि उस पद से आजीवन निर्वासन अभिप्रेत है, तो उसका अर्थ आजीवन कारावास के प्रति निर्देश होना लगाया जाएगा;

(ख) यदि उस पद से किसी लघुत्तर अवधि के लिए निर्वासन अभिप्रेत है, तो यह समझा जाएगा कि वह लुप्त कर दिया गया है।
