Section 5 SC ST Act: “Enhanced punishment subsequent conviction”–

Whoever, having already been convicted of an offence under this Chapter is convicted for the second offence or any offence subsequent to the second offence, shall be punishable with imprisonment for a term which shall not be less than one year but which may extend to the punishment provided for that offence.

Section 5 of SC ST Act 1989 in Hindi / अनुसूचित जाति और अनुसूचित जनजाति (अत्याचार निवारण) अधिनियम की धारा 5 का विवरण : पश्चातवर्ती दोषसिद्धि के लिए वर्धित दंड-

कोई व्यक्ति जो, इस अध्याय के अधीन किसी अपराध के लिए पहले ही दोषसिद्ध हो चुका है, दूसरे अपराध या उसके पश्चात्वर्ती किसी अपराध के लिए दोषसिद्ध किया जाता है, वह कारावास से जिसकी अवधि एक वर्ष से कम नहीं होगी किंतु जो उस अपराध के लिए उपबंधित दंड तक हो सकेगी, दंडनीय होगा।
