Section 38 of IPC 1860:-Persons concerned in criminal act may be guilty of different offences -

Where several persons are engaged or concerned in the commission of a criminal act, they may be guilty of different offences by means of that act.

Illustration

A attacks Z under such circumstances of grave provocation that his killing of Z. would be only culpable homicide not amounting to murder. B, having ill-will towards Z and intending to kill him, and not having been subject to the provocation, assists A in killing Z. Here, though A and B are both engaged in causing Z's death, B is guilty of murder, and A is guilty only of culpable homicide.

आईपीसी, 1860 (भारतीय दंड संहिता) की धारा 38 का विवरण - आपराधिक कार्य में संपृक्त व्यक्ति विभिन्न अपराधों के दोषी हो सकेंगे -

जहां कि कई व्यक्ति किसी आपराधिक कार्य को करने में लगे हुए या सम्पृक्त हैं, वहां वे उस कार्य के आधार पर विभिन्न अपराधों के दोषी हो सकेंगे।

दृष्टांत

क गम्भीर प्रकोपन की ऐसी परिस्थितियों के अधीन य पर आक्रमण करता है कि य का उसके द्वारा वध किया जाना केवल ऐसा आपराधिक मानव वध है, जो हत्या की कोटि में नहीं होता है। ख जो य से वैमनस्य रखता है, उसका वध करने के आशय से और प्रकोपन से वशीभूत न होते हुए य का वध करने में क की सहायता करता है। यहां यद्यपि क और ख दोनों य की मृत्युकारित करने में लगे हुए हैं, ख हत्या का दोषी है और क केवल आपराधिक मानव वध का दोषी है।
